Terms of sale
1 - Identification of the seller
Swag Chuds, an individual company, registered with the Registre du Commerce et des Sociétés (RCS) under number 92513612900036, whose registered office is located at 7 ter Boulevard d'alembert, Guyancourt 78280, France.
VAT non applicable due to article 293 B of CGI (french taxes code).

2 - Scope & acceptance
These GTCS apply to all orders placed on thelarpfactory.com by any natural or legal person ("Buyer"), regardless of nationality or place of residence, subject to the mandatory rules of the Buyer's country of residence where applicable.
By validating an order, the Buyer expressly and unreservedly accepts these GTCS in their entirety. The GTCS in force at the time of the order are archived and may be provided on request.
These GTCS are drafted in French. In the event of contradiction between a translated version and the French version, the French version shall prevail.
3 - Products & availability
Products are described as accurately as possible on the website. Photographs are not contractually binding. In the event of a discrepancy between a photograph and the written description, the written description shall prevail.
All offers are valid while stocks last. If a product becomes unavailable after an order has been confirmed, the Buyer will be informed as soon as possible and offered either a substitute product of equivalent quality and price, or a full refund within 14 days.
We reserve the right to modify, suspend, or withdraw any product from our catalogue at any time without prior notice, subject to existing confirmed orders.
4 - Pricing & VAT
All prices are displayed according to your location or in EURO(€) inclusive of all taxes (TTC — toutes taxes comprises), including French VAT at the applicable rate. Delivery costs are not included and are displayed separately before order confirmation.
Prices may be modified at any time. However, orders will be invoiced at the price in effect at the time the order is confirmed, subject to availability.
An invoice is systematically issued for every order and sent by email. As required by French law (Article 289 of the French Tax Code — Code Général des Impôts), the invoice includes our VAT number, the applicable tax rate, and the total tax amount.
5 - Order process
Orders are placed electronically via the website. The order process consists of the following steps:
- Selection of products and addition to the shopping cart.
- Review of the cart and modification if necessary.
- Entry of delivery and billing information.
- Selection of payment method and review of the total amount.
- Acceptance of the GTCS and confirmation of the order ("double-click" rule — Article 1127-2 of the French Civil Code).
- Receipt of an order confirmation email with a summary and order number.
The sale is deemed concluded upon dispatch of the order confirmation email. We reserve the right to refuse any order for legitimate reasons, including suspected fraud, payment refusal, or abnormal quantities.
6 - Payment
Payment is due in full at the time of placing the order. We accept the following payment methods:
- Credit and debit cards (Visa, Mastercard, American Express).
All transactions are secured using SSL/TLS encryption. Payment card details are never stored by us; they are processed directly by our certified payment service provider.
In the event of payment failure, the order will be automatically cancelled. Title to the goods passes to the Buyer only upon full receipt of payment (retention of title clause — Article 2367 of the French Civil Code).
7 - Delivery
Products are delivered to the address specified by the Buyer at checkout. Delivery is available within metropolitan France and internationally, subject to applicable restrictions.
Estimated delivery times are provided at checkout and are indicative only. In the event of delay exceeding 7 days beyond the announced date, and after formal notice sent by the Buyer, the Buyer may cancel the order and receive a full refund within 14 days, in accordance with Article L. 216-2 of the French Consumer Code.
- Risk of loss and damage passes to the Buyer (consumer) upon physical receipt of the goods.
- For professional Buyers, risk passes upon handover to the carrier.
- The Buyer must inspect goods upon delivery and report any damage to the carrier immediately and to us within 3 working days.
Delivery costs are specified at checkout and depend on the destination, weight, and selected carrier. Free delivery may be offered above a certain order threshold as displayed on the website.
8 - Right of withdrawal
To exercise this right, the Buyer must notify us before expiry of the 14-day period by any unambiguous statement (e.g. letter, email, or by using the standard withdrawal form below). The Buyer then has a further 14 days to return the goods.
Return costs are borne by the Buyer unless we have agreed otherwise or failed to inform them of this obligation. Refunds will be issued within 14 days of receipt of the returned goods or proof of dispatch, whichever is earlier, using the same payment method as the original transaction.
The right of withdrawal does not apply to:
- Goods made to the Buyer's specifications or clearly personalised.
- Goods liable to deteriorate or expire rapidly.
- Sealed goods that have been unsealed after delivery and are unsuitable for return for hygiene reasons.
- Digital content supplied on a non-tangible medium where performance has begun with the consumer's prior consent and waiver of the right of withdrawal.
- Services fully performed before the end of the withdrawal period with the consumer's prior consent.
9 - Legal warranties
All products sold benefit from the following mandatory legal warranties under French law, which cannot be excluded or limited by contract:
- Legal warranty of conformity Art. L.217-4 C. conso. — 2 years from delivery. Defects appearing within 24 months are presumed to have existed at delivery. The Buyer may request repair, replacement, or, where neither is possible, a price reduction or full refund.
- Warranty against hidden defects Art. 1641 C. civ. — The Buyer may invoke this warranty within 2 years of discovering the defect, and choose between cancellation of the sale or a price reduction.
To invoke a warranty, the Buyer should contact us at the details in Article 1 with proof of purchase and a description of the defect. We will respond within a reasonable time and bear all costs (collection, repair, return) where the warranty applies.
Any commercial warranty offered voluntarily is additional to, and does not replace, these mandatory statutory warranties.
10 - Returns & refunds
Outside the right of withdrawal and legal warranty cases, returns are accepted within 14 days of delivery provided the product is returned in its original condition, unused, and in its original packaging, together with all accessories and proof of purchase.
Refunds are processed via the original payment method within 14 days of receiving the returned item and confirming its condition. Items that are damaged, incomplete, or show signs of use beyond what is necessary to assess their nature and functioning may be subject to a partial refund or refused entirely.
11 - Liability
Our liability cannot be engaged for indirect or unforeseeable damages, loss of profit, commercial loss, or loss of data arising from use of our products or website, except in cases of gross negligence or wilful misconduct on our part.
We are not liable for damages arising from: force majeure events (as defined by Article 1218 of the French Civil Code), actions of third parties, or misuse of the products by the Buyer.
For professional Buyers, our total liability in connection with any order is limited to the amount paid for that order. This limitation does not apply to consumer Buyers, who retain all rights under mandatory French consumer protection law.
12 - Personal data (GDPR)
Personal data collected during the order process is processed by [Company Name] as data controller, for the purposes of order management, delivery, invoicing, and customer relationship management.
The legal basis for processing is the performance of a contract (Article 6(1)(b) GDPR). Data is retained for the duration of the contractual relationship and for a further period of 5 years for accounting and legal compliance purposes.
In accordance with French law (Loi Informatique et Libertés n°78-17) and the GDPR, the Buyer has the right to:
- Access, rectify, and erase their personal data.
- Restrict or object to processing.
- Data portability.
- Lodge a complaint with the French data protection authority (CNIL) at www.cnil.fr.

13 - Dispute resolution
In the event of a dispute, the Buyer is invited to contact our customer service team in the first instance to seek an amicable resolution. We will respond within 15 business days of receiving a written complaint.
14 - Governing law
These GTCS and all transactions concluded thereunder are governed exclusively by French law, including but not limited to the French Civil Code, the French Commercial Code, and the French Consumer Code.
For consumer Buyers residing in the European Union, the mandatory consumer protection provisions of their country of habitual residence shall apply where they afford greater protection than French law.
If any provision of these GTCS is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
